Brandybrook Subdivision Building Restrictions
for Architectural Control Board (ACB)
Improvements
Included in the price of each lot is permanent asphalt streets with concrete curb and gutter, underground electricity, gas, telephone, and water. Homesites will require a mound system.
The building requirements are as follows:
1. Minimum Building Standards
Ranch Style: 2,600 sq. ft.
1 Story: 3,000sq. ft. (2,000 sq. ft. on 1st Floor)
2 Story: 3,000 sq. ft.
Split Level: 3,000 sq. ft.
Tri-Level: 3,000 sq. ft.
2. Exterior
All exterior walls shall be constructed of brick, stucco, dryvit, stone, wood, Hardiplank, Chem-plank, other concrete fiber products acceptable to ACB, or other natural materials.
3. Garages
All homes shall have a minimum of a two-car attached, side entry garage. Front entry garages may be allowed at the sole discretion of the ACB in cases where ACB determines due to aesthetics, size of lot, lot frontage, topography, or other reasons deemed appropriate.
4. Roof Type
All homes are required to have roofs of wood shakes, tile, 40 year fiberglass or asphalt shingles acceptable to ACB, or other approved roofing material. All ranch style homes are required to have a minimum pitch of 10/12, and all other homes including 1 story, 2 story, split-level, and tri-level are required to have a minimum pitch of 8/12.
5. Fireplaces
All exterior fireplaces and chimneys shall be constructed of masonry or stone materials.
6. Completion
Any Single-Family Residence, attached garage, landscaping and/or paved driveway shall be completed within 18 months from the start of construction
7. Lamppost
At the time of construction of a Single-Family Residence, the Owner of such Single-Family shall install, at the Owner's expense, one (1) outdoor electric lamppost (the design and quality of which shall be specified by the ACB), with an unswitched photo-electric cell, at a location on the Lot deemed appropriate to the subdivision, at the ACB's discretion. The lamppost shall be maintained by the Owner, at the Owner's expense, in a proper operating manner.
8. Setbacks
Minimum setbacks from any abutting street right-of-way shall be 50 feet. Side yard setbacks shall be 20 feet and rear yard setbacks shall be 50 feet.
9. Vehicle Storage
There shall be no outside storage of boats, trailers, buses, commercial trucks, and recreational vehicles.
10. Mailbox Design
The design (including materials) and location of each mailbox/newspaper box shall be subject to the approval of the ACB, in ACB's discretion.
11. Window Trim
Front and side elevation windows on Single-Family Residences must be trimmed out using casing, shutters, or any other trim approved in writing by the ACB. The ACB shall have the right to make changes for aesthetic purposes.
12. Soil Removal
No soil shall be removed from any lot in the Subdivision without the prior consent of the ACB or its duly appointed agent. Any excess soil resulting from excavations shall be transported, at the lot buyer's expense, to such other places in the Subdivision or on other property as may be designated by the ACB.
13. Street Trees
The Owners of the Lots in Brandybrook Subdivision shall, at the time such Lots are landscaped pursuant to the requirements of the Declaration, plant three (3) trees with a minimum two and one-half to three inch (2.5-3.0“) trunk diameter at grade ($1,500 will be held back at time of closing and will be refunded after owner installs trees) along the front lot line of such Lots in such locations as are specified by the ACB on the stakeout survey that must be approved prior to construction.
14. Exterior Restrictions
There shall be no outbuildings, above ground swimming pools, tennis courts or satellite dish antennas (having a diameter in excess of twenty-four (24) inches). No antenna or permitted satellite dish shall be visible from any roadway or neighboring Lot.
15. Plan Approval / Architectural Control Board
All building plans for any Single-Family Residences or other permitted improvements, including, but not limited to, the exterior design and color of each building to be constructed, and all yard grades and stake out surveys showing erosion control measures shall be submitted to the Declarant for approval. After the control of the Homeowners Association is transferred from the Declarant and Declarant turns over his authority, an Architectural Control Board will be established to approve the above mentioned plans or other permitted improvements.
16. Community Water System
The Brandybrook Subdivision will be serviced by a community water system. The individual lot owners will be charged a quarterly usage fee. |
